Terms of Service

These Terms of Service ("Terms") govern your access to and use of FoodXChange (the "Service"), operated by the FoodXChange team ("we," "us," or "our"). By accessing or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

FoodXChange is a free, community-run platform that lets neighbors give away surplus food ingredients — vegetables, pantry staples, baked goods, eggs, and similar items — to people nearby. No money changes hands through the app; all items must be offered at no cost. We provide the technology to connect people; we are not a food producer, supplier, retailer, or delivery service.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service independently. If you are at least 13 but under 18, you may only use the Service with the express consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. We do not knowingly permit children under 13 to use the Service.

• Provide accurate, complete, and up-to-date information in your listings. Do not misrepresent an item's contents, freshness, or condition.
• Only share food that you can legally give away and that you genuinely believe is safe and suitable for consumption.
• Arrange pickups respectfully and safely. Meet in publicly visible locations whenever possible.
• Do not harass, threaten, or discriminate against other members.
• Do not use the Service for commercial purposes. All listings must be free of charge.
• Do not post spam, duplicate listings, or content unrelated to food sharing.
• Comply with all applicable local laws and regulations regarding food handling and transfer.

You retain ownership of the content — photos, descriptions, messages — that you post on FoodXChange. By posting content, you grant FoodXChange a non-exclusive, royalty-free, worldwide license to display and transmit that content within the Service solely to facilitate ingredient sharing between members. We do not claim ownership of your content and will not use it for any purpose outside the Service without your permission.

You are solely responsible for the content you post. Do not post content that is unlawful, defamatory, obscene, or that infringes the rights of any third party.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the contact address below if you suspect unauthorized access to your account.

We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a safety risk to the community — with or without prior notice, depending on the severity of the violation.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, FoodXChange disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, FoodXChange and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to illness or injury from food obtained through the Service, loss of data, or interruption of service.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Material changes will be communicated through the app. Continued use of FoodXChange after any change constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles, and any disputes will be handled by the state or federal courts located there. If you use FoodXChange from outside the United States, you are responsible for complying with your local laws.
